1)                   Information regarding the collection of personal data and contact details of the controller

1.1 We are pleased that you are using our application (hereinafter referred to as the ‘app’). We have outlined how your personal data is handled when using our app below. The term ‘personal data’ refers to all data with which you can be personally identified.

1.2 The controller for data processing regarding this app in terms of the

General Data Protection Regulation (GDPR) is TARGA GmbH, Coesterweg 45, 59494 Soest, Germany, Tel.: (+49-2921) 380-380, Fax: (+49-2921) 3803-890, E-mail: targa@targa-online.com. The controller of personal data is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.

1.4 For security reasons and to protect the transfer of personal data and other confidential content (e.g., orders or requests to the controller), this app uses SSL or TLS encryption. You can recognise an encrypted connection from the character string "https://" and the lock symbol in your browser line.

2)     Logfiles during installation and use of our mobile app and the web interface

 

2.1 Installation

When you download our mobile app from an app store, the required information is transferred to the app store, including – but not limited to – your account username, e-mail address and customer number, time of download, payment information and individual device ID number. We have no influence on the collection of this data and are not responsible for it. We process the data only to the extent necessary for downloading the mobile app to your mobile device.

 

2.2 Use

When you use our mobile app and the web interface, in particular the update function to update the firmware of your repeater, we collect the following data, which is technically necessary for us to offer you the functions of our mobile app and to guarantee stability and security:

-   Date and time of request

-   Time zone difference to Greenwich Mean Time (GMT)

-   Content of the request

-   Access status/http status code

-   Volume of data sent in bytes

-   Source/link from which you reached the site

-   Browser used

-   Language and version of the browser software

-   Operating system used and its interface

-   IP address used (in anonymised form)

Processing is carried out pursuant to Article 6(1)(f) of the GDPR on the basis of our legitimate

interest in improving the stability, security and functionality of our app and our systems.  The data will not be shared or used in any other way. However, we reserve the right to check the aforementioned log files retrospectively if there are well-founded indications of illegal use.

3)     Collection of location data

- With consent

Our offer includes ‘location-based services’ by which we provide you with special offers that are tailored to your particular location. You can only use this function after you have agreed via a pop-up that we may collect your location data via GPS and your IP address in anonymised form for the purpose of rendering this service. You can enable or disable the function in the settings of the app or your mobile operating system at any time. Your location will only be transferred to us if you use the app to access functions that we can only offer you if we know your location.

4)     Rights of the data subject

4.1 The applicable data protection law provides you with extensive rights as a data subject (information and intervention rights) vis-à-vis the controller in terms of processing of your personal data

, which we have outlined below:

-   Right of access by the data subject pursuant to Article 15 of the GDPR: In particular, you shall have the right to be informed about whether your personal data is processed by us, the purposes of said processing, the categories of personal data processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the envisaged period for which the personal data will be stored or the criteria used to determine that period, the existence of a right to rectification, erasure, restriction of processing, opposition to processing, complaint with a supervisory authority, the source of your data if we have not collected it from you, the existence of automated decision-making including profiling and, where applicable, meaningful information on the logic involved and the significance and the envisaged consequences of such

processing, as well as your right to be informed of the safeguards provided pursuant to Article 46

of the GDPR where your data is transferred to third countries;

-   Right to rectification pursuant to Article 16 of the GDPR: You shall have the right to obtain without undue delay the rectification of inaccurate personal data or to have incomplete personal data we have stored completed;

-   Right to erasure pursuant to Article 17 of the GDPR: You shall have the right to request the erasure of your personal data if the requirements of Article 17(1) of the GDPR are met. However, this right shall not apply in particular

where processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;

-   Right to restriction of processing pursuant to Article 18 of the GDPR: You shall have the right to request the restriction of processing of your personal data provided that the accuracy of your data which you contest is verified, if you oppose the erasure of your personal data as a result of unlawful data processing and instead request the restriction of its use instead, if you require your data for the establishment, exercise or defence of legal claims after we no longer need this data for the purposes of this processing, or if you have objected to processing for reasons related to your particular situation, pending the verification of whether our legitimate grounds override yours;

-   Notification obligation regarding rectification or erasure of personal data or restriction of processing pursuant to Article 19 of the GDPR: If you have asserted the right to rectify, erase or restrict the processing of data vis-à-vis the controller, the controller shall be obliged to notify each recipient to whom the personal data concerning you has been disclosed of this rectification, erasure or restriction of processing, unless this proves impossible or involves disproportionate effort. You shall have the right to be informed about these recipients.

-   Right to data portability pursuant to Article 20 of the GDPR: You shall have the right to receive the personal data that you have provided us with in a structured, commonly used and machine-readable format and have the right to transmit such data to another controller, insofar as this is technically feasible;

-   Right to withdraw consent pursuant to Article 7(3) of the GDPR: You shall have the

right to withdraw your consent to data processing at any time with future effect. In the event of the withdrawal of your consent, we shall immediately delete the data concerned if further processing cannot be supported by a legal basis for processing without consent. The withdrawal of consent

shall not affect the lawfulness of processing based on consent

before its withdrawal;

-   Right to lodge a complaint with a supervisory authority pursuant to Article 77 of the GDPR: If you believe that the processing of personal data relating to you infringes the GDPR, you have the right – without prejudice to any other administrative or judicial remedy – to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement.

4.2 RIGHT TO OBJECT

IF, IN THE COURSE OF A BALANCING OF INTERESTS, WE PROCESS YOUR PERSONAL

DATA ON THE BASIS OF OUR LEGITIMATE INTEREST,

YOU HAVE THE RIGHT TO OBJECT TO SUCH PROCESSING AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION WITH FUTURE EFFECT.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE

PROCESSING OF THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO FURTHER PROCESSING

IF WE HAVE COMPELLING REASONS WORTHY OF PROTECTION FOR SUCH

PROCESSING WHICH RESPECT YOUR INTERESTS, BASIC RIGHTS AND FUNDAMENTAL FREEDOMS

OR IF THE PROCESSING SERVES THE PURPOSES OF THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

5)     Retention period of personal data

The retention period of personal data is determined by means of the respective legal basis, the purpose of processing and – if relevant – additionally by the respective legal retention period (e.g., retention periods under commercial and tax law).

In terms of processing personal data on the basis of explicit consent pursuant to Article 6(1)(a) of the GDPR, this data is stored until the person concerned withdraws his or her consent.

If legal retention periods exist for data which is stored within the scope of legal or similar obligations on the basis of Article 6(1)(b) of the GDPR, this data is routinely erased after the expiry of the

retention periods, provided it is no longer required for

contract performance or contract initiation and/or we have no legitimate interest in its further retention.

In terms of processing personal data on the basis of Article 6(1)

(f) of the GDPR, this data is stored until the person concerned has exercised his or her right to object pursuant to Article 21(1) of the GDPR, unless we can demonstrate compelling reasons for processing that are worthy of protection and outweigh the interests, rights and freedoms of the data subject, or the processing serves to establish, exercise or defend legal claims.
The log data listed under point 2), which are processed on our servers based on point (f) of Art. 6(1) GDPR and record page impression errors, are erased after seven days. In addition to the error messages, this data includes the accessing IP address and, depending on the error, the accessed website.   

Provided that the other information in this declaration concerning specific

processing situations does not otherwise indicate, stored personal data shall be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
